Privacy Informations - Information pursuant to Section 13 of the Italian Legislative Decree no. 196 of 30 June 2003

Informative Note pursuant to Art. 13 of L.D. 196 dated June 30th 2003 - Personal Data Protection Code.

 

The purpose of this registration is to allow you to access the services reserved to registered users on the shop.ducati.com website (hereafter the “Site”) to speed up and facilitate the submission of any purchase orders via the Site and, if you so wish, enable you to be contacted and receive information, some customised, on Ducati’s sales promotions and activities.

Personal data will be processed by the Data Controller Ducati Motor Holding S.p.A Sole shareholder company - A company subject to Management and Coordination by AUDI AG, with registered office in via Cavalieri Ducati no. 3, Bologna, Italy (hereafter “Ducati”), and the Chief Processor Triboo Digitale S.r.l., with registered office in Viale Sarca no. 336, Milan, Italy (hereafter “Triboo Digitale”) which also acts as Joint Data Controller exclusively for the processing activities referred to in section (i) below, [and its own Chief Processor&nbsp], using manual and automated systems, in compliance with what required by L.D. no. 196 dated June 30th 2003 – Personal Data Protection Code (so-called Privacy Code), for the following purposes:

to consent registration on the Site owned by Ducati, to access and execute the services reserved to registered Users and simplify the submission of orders via the Site for products available on the Site, to complete the purchase transaction with Triboo Digitale (Ducati agent assigned to manage the sale of merchandise via Ducati’s own shop.ducati.com online store)  further to the implementation and fulfilment of all consequent services and obligations, including all administrative and accounting formalities by Triboo Digitale. For these exclusive purposes, your data may be communicated to subjects with whom Ducati and Triboo Digitale have specific contracts (i.e.  importers, distributors, dealers, service networks, banks and credit institutes, Internet operators, shippers and couriers),  which may have their headquarters outside the EU  which do not guarantee a suitable level of protection of personal data and, in this case the data will be processed exclusively for the above indicated purposes;  personal data will be accessed by the Chief Processors and the Designated Officers appointed by the Ducati and Triboo Digitale and the above mentioned subjects. If you decide to make a purchase from this Website, your e-mail address may be used to inform you of any news, promotions and special offers relating to Ducati manufactured and Ducati branded merchandise: should you decide you would rather not receive such information, simply send an e-mail to: unsubscribe-shop.ducati@triboo.it at any moment in time. During the product purchase process on the Site, the IP of the User visiting the Site and submitting the order will also be recorded for the sole purpose of ascertaining and suppressing possible criminal offences of the illicit use of the Site, further to anti-fraud activities.

 (ii) to send advertising materials and newsletters, to provide commercial information, via e-mail and standard mail, on promotional and marketing activities available on the Ducati Website, further to the sales and service networks and those of its Partners, in order to conduct market research and customer satisfaction surveys. For these exclusive purposes, your data may be communicated by Ducati to companies with whom Ducati has specific contracts (i.e. companies specialised in market survey, data processing or advertising services)  to Ducati Group companies, to Ducati affiliated companies which are part of the distribution and services network (such as branches, importers, distributors, dealers, service workshops), which may have their headquarters outside the EUwhich do not guarantee a suitable level of protection for personal data and, in this case the data will be processed exclusively for the above indicated purposes;  personal data will be accessed by the Chief Processors and the Designated Officers appointed by Ducati and the above mentioned subjects. (iii) to allow Ducati to profile the User, i.e. define the profile and analyse the consumer habits and choices, and use the information to target its marketing and commercial proposal activities. The data processed for such purposes, mainly using electronic means, may be in particular: name and surname, email, gender, date of birth, residence/domicile address (city, post code, country, province/region) data concerning purchases made previously on the Site (products ordered, shipping methods requested, selected payment method, order value, order date), list of products included on the User's "Wishlist", registration on the Site or subscription to the Site newsletter.  For these exclusive purposes, your data may be communicated by Ducati to companies with whom Ducati has specific contracts (i.e. Internet provider and telecommunication operators, IT and telematic service providers, companies specialised in data processing)  to Ducati Group companies, to Ducati affiliated companies which are part of the distribution and services network (such as branches, importers, distributors, dealers, service workshops), which may have their headquarters outside the EUwhich do not guarantee a suitable level of protection for personal data and, in this case the data will be processed exclusively for the above indicated purposes;  personal data will be accessed by the Chief Processors and the Designated Officers appointed by Ducati and the above mentioned subjects. Except for the aforementioned purposes, no submitted personal data will be disclosed or disseminated to third parties. User information submitted during the registration process may be cross-checked with other data in the legal possession of Ducati, and submitted by the same User in other circumstances, to update the relative master files.

Personal Data Protection Code

Article 7. Rights to access personal data and other rights.

1. The Data Subject  has the right to request confirmation as to whether or not personal data concerning you exists, regardless of their being already recorded, and communication of such data in an intelligible form.

2. In particular, the subject has the right to obtain indications on: a) to receive information on the origin of the personal data; b) on the purpose and processing methods; c) on the logic used in the case where the data is processed using electronic equipment; d) on the personal data of the Controller, the persons in charge and the designated representatives pursuant to Art, 5 paragraph 2; e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of such data in their capacity as Designated Representatives for the Country or Persons in Charge of Processing.

3. The Data Subject has the right to obtain indications on : a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymisation or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.

4. The interested party is entitled to refuse total or partial: a) processing of personal data, for legitimate reasons, despite them being relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
